By placing an order with maihomedecor.com, you explicitly accept our General Conditions of Sales stated here under as well as the Worldwide Delivery Policy, Delivery Terms and Exchange and Return Policy found on the website. Maihomedecor.com reserves the right to change these General Conditions of Sales, Worldwide Delivery Policy, Delivery Terms and Exchange and Return Policy at any time. In the case of a completed transaction, the terms apply as they did on the date mentioned on the invoice.

 

Guaranteed / Fixed price

Maihomedecor.com guarantees that the price mentioned on the invoice is a fixed price. However, for incorrect prices due to server problems, hackers, computer viruses etc. we cannot take responsibility.

 

Cancellation / Return and Exchange / Damage and defect

Please note that all sales are final once the products have been ordered and paid through the website. Products cannot be cancelled or returned once payment is done. They can only be exchanged in case of damage or defect.

We take great care in our products and their quality and packing and will make every effort to satisfy you. However, if you are not completely satisfied, please contact our after-sales service at contact@maihomedecor.com, specifying all the information regarding your order (your contact details, date and reference) and the reasons for your claim or complaint and for asking for an exchange. Any exchange of merchandise due to damage or defect is subject to prior approval from us.

Damage and defect due to shipping or during shipping need to be reported immediately upon reception of the merchandise and a claim needs to be lodged at once to the delivery company and its agent who has delivered the good. You should not accept the delivery by the agent if the product is damaged. The delivery company and maihome decor.com will not accept any claim for damage or defect due to or during transportation if a claim has not been filed and signed off by the delivery company / agent, upon delivery of the merchandise with damage.

Upon delivery, we recommend that you inspect carefully the outside box containing the product and check for apparent damage to the box, before signing any paper for acceptance of reception of the merchandise in good order. If the box is damaged, you should open the box in the presence of the delievry agent, take all necessary pictures of the damaged box and damaged product and have your claim signed off by the delivery agent. Do not accept the delivery and have the merchandised taken back by the delivery agent.

You shall then notify us of a product claim due to damage or defect upon delivery, by email or registered letter, no later than 72 hours after the good was delivered to your address or picked up by you and you did not accept it because of apparent damage(s). You should send us pictures as well as a copy / scan of the claim report signed off by the delivery agent. We will then coordinate with the delivery company, and exchange the merchandise as soon as possible after the delivery company has accepted the claim, which shall take a maximum of 10 days for them to inquire and check.

Delivery

Mai Home Decor aims to keep in stock all articles in semi finished format ready to undergo the final lacquer coatings of your choice (lacquer colors and patterns) and deliver the product within 14 to 30 days depending on the country of delivery.

If the semifinished format of the said product is available in stock, you can add it to your cart and purchase it on line. We will produce it to the product color(s) and pattern(s) specifications and have it delivered it to you address. Please note that delivery times are indicative only as we cannot be held responsible if they vary due to the forwarder. Please allow for variations of up to 10-15 days compared to the mentioned date.

Please ensure that you fill out your address correctly. If your address is not filled out correctly, and the order cannot be delivered, maihomedecor.com cannot be held responsible. Please note that we cannot deliver to a P.O. Box. If you still wish to receive your order after it has been returned to us due to an incorrect address, we can resend it to you after we receive payment of the extra shipping costs. Please note that you shall incur any damage costs during delivery to a wrong address.

If the semi finished product is not available in stock, or the product is only made to order, or it is too bulky to be shipped using the normal shipping procedure, you will not be able to add it to your cart and purchase it online. Please click on the buttom "Make Enquiry" and fill in the form instead. We will come back to you quickly with a separate quotation by email detailing the price, estimated delivery time and delivery charge.

 

Restrictions on quality claim due to product nature being Arts and Crafts

You recognize and fully understand that Mai Home products are artisanal Arts and Crafts lacquer products, hand-made and crafted by artisans, and that by nature they cannot be reproduced every time exactly identical. You acknowledge that the product pictured on the website might be slightly different with the one you receive.

We do commit however to deliver quality products in appearance and durability according to Mai Home’s quality charter, and and as close as possible to the product pictures on the website. Because of the nature of our products being artisanal Arts and Crafts lacquer product, you agree not to make unreasonable claims and demands on the Product that cannot be fulfilled by standard level of lacquer craftsmanship. Under the above restrictions and conditions, we thus warrant that our Products shall be free from defects in material and workmanship for 3 months after the date you receive the good(s).

 

Warranty conditions

Cases of damage upon delivery during transportation will only be dealt with if maihomedecor.com receives notice within 3 days of the buyer receiving the article(s). If the article(s) are damaged and the complaint is upheld by the forwarder and maihomedecor.com after investigation, any shipping costs for returns shall be borne by maihomedecor.com.

After the 3 day notice time for damage upon reception of the good(s) or due to transporation, all article(s) receive a 3-month warranty on purchase. Maihomedecor.com guarantees that all delivered article(s) live up to the required demands of existing regulations and protocols and that the article(s) are delivered in new and working condition. If during normal use of the article it fails within the 3-month warranty, maihomedecor.com will repair or replace the article free of charge. It is maihomedecor.com responsibility to determine whether any article(s) are under warranty, and how best to repair and ship the return or replacement. Postage free return shipments are not accepted by maihomedecor.com, any costs arising from this method being used, are the responsibility of the customer.

Any claim for defect in material or workmanship shall be submitted by email and by registred mail and shall include an explanation of the circumstances leading to such claim. You shall bring tangible proofs (photos, reports, etc.) demonstrating a manufacturing fault to benefit from this warranty. Upon reviewing photos and reports of the defective Product, we shall try to determine the cause of the defects and responsibilities and shall advise you whether we accept or not the claim.

If a defect is determined by us to have been caused by you or by some equipment under your control, we shall have no obligation to repair or replace the defect products. If you still want the product to be repaired or replaced by us, you agree to bear the cost for such repair or replacement.

If we accept the claim, we shall take action to correct such defect by repair and/or replacement. The Company liability under this warranty is limited to repair or replacement of the defective part or of the Product and that liability shall in no case exceed the initial purchase price of the applicable Product. If you return any article(s) for repair or replacement upon our acceptance, you will need to send them in the original packaging with a copy of the invoice and a filled out return form with a description of the complaint to:

Any article(s) returned without the required return form and a copy of the invoice, will not be dealt with.

Mai Home reserves the right to void the warranty of a merchandise within its warranty period should the product be found to have been subjected to adverse conditions, not exclusively or limited to conditions such as bad weather, abuse, or placement of the merchandise in publicly accessible locations that causes the merchandise to be subjected to damage, intentional or otherwise.

The warranty will not apply in the following circumstances (but not limited to):

  1. Item(s) damaged due to negligent maintenance
  2. Item(s) altered by a third party
  3. Invoice date was altered or made illegible
  4. Item(s) damaged by improper or inaccurate use (e.g. by not following the instructions)
  5. Item(s) damaged intentionally or due to gross negligence
  6. Item(s) damaged by external factors
  7. Item(s) became overheated after exposure to central heating or another heat source; or from using a higher wattage than advised
  8. Item(s) damaged after exposure to moisture, water, extreme heat, extreme cold or sunlight
  9. Any repair costs as a direct result of third-party damage will not be compensated

Personal information will not be kept on file, unless you wish to be informed about our special offers, new products and other information provided by maihomedecor.com. Your e-mail address will be added to the maihomedecor.com mailing list and shall not be used otherwise, or forwarded to any third party. For more information please refer to our privacy policy.

 

Governing Laws and Dispute Resolutions

This Agreement shall be governed by and construed in accordance with the laws of Singapore, where Mai Home Décor Pte. Ltd. is registered.

Any dispute, controversy or claim arising out of or relating to sales through this website or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the Arbitration Rules of the Singapore Arbitration Institute, Office of the Judiciary applicable at the time of submission of the dispute to arbitration and the conduct of the arbitration thereof shall be under the auspices of the Singapore Arbitration Institute.

The arbitration shall be conducted in English language in Singapore. Each Party shall appoint 1 arbitrator, and the two arbitrators shall select the third arbitrator. The arbitration award shall be final and binding among the Parties.

The winning Party in any arbitration, litigation or other legal proceeding arising out of or relating to or in connection with this Agreement shall be entitled to recover from the losing Party all fees, costs and expenses for attorneys, arbitrators, experts and other third parties incurred by such winning Party in connection with such arbitration, litigation or other legal proceeding (including any appeals and actions to enforce any arbitration awards and court judgments).
